Assessor
What is homestead and what is needed to apply?

Homestead is a property tax reduction program, intended to keep taxes lower on owner-occupied homes, according to Minnesota Statute 273.124. In order to receive homestead exemption, you must present proof of ownership, complete a homestead application and provide the social security numbers of all owners. You must be listed as the owner on county tax records.

You must be owner and occupant by December 1st of the current year. The homestead application must be turned into the County Assessor's Office by December 15th to be eligible for the homestead classification for taxes payable in the following year.

When is the value of my property established?

The assessment date is January 2nd of each year and the assessor determines a full or partial value of new construction, or improvements depending upon the state of completion as of that date.

Will the Assessor's Office notify me of my property value and what I can do if I feel a mistake has been made?

After the assessment is completed notices are mailed to the property owners, this notice will state the following:

1. Current estimated market value from January 2nd and the prior assessment year.

2. Limited market value for the current and prior assessment year.

3. Classification of the property for the current and prior year.

4. Taxable market value for the current and prior assessment year.

5. Information for appealing the estimated market value or classification if you feel an error has been made on your property record.

It is very important that the property owner review this notice. The values stated on the notice will be used to calculate the taxes payable in the following year.

The County Attorney's Office cannot make recommendations regarding private attorneys. You can search the yellow pages, call the Minnesota Attorney Referral Service at 1-800-292-4152, or go to the Minnesota State Bar Association website at www.mnbar.org. As a general rule, reports and records are maintained by the department that generates them. Official copies of criminal reports are maintained at the Law Enforcement Center or Police Department records sections, so your first request should be directed to your local law enforcement center. The records section may have to refer you to us if data privacy issues exist, and in that case we will do our best to help you.

Can I report a crime to the County Attorney's Office?

The crime should be reported to the police department in the city where the crime was committed. If the crime was committed in a township, the crime should be reported to the Rice County Sheriff at (507)332-6022 (from Lonsdale call (507)744-5185, from Northfield call (507)645-9576) or if it is an emergency call 911.

How does a judge decide a sentence?

If the crime is a felony, the sentencing judge must apply the Minnesota Sentencing Guidelines which give a presumptive sentence that a defendant should receive based upon the seriousness of the crime and the defendant's criminal record. When a probationary sentence is called for by the Guidelines, a judge may impose county jail time, fines, treatment, restitution, or other requirements as conditions of probation. Before sentencing, a pre-sentence investigation may be prepared which includes a social history of the defendant, criminal history of the defendant, victim impact and other information and recommendations. The prosecutor and defense attorney also may make recommendations to the judge regarding sentencing.

If the judge is sentencing a defendant for a misdemeanor or gross misdemeanor offense, the judge relies on the judge's experience and past sentencing practices. Occasionally, there is a mandatory minimum sentence that is required. There are no sentencing guidelines for misdemeanors or gross misdemeanors.

I am a victim. How can I be compensated for my loss?

The sentencing judge as a condition of the defendant's probation or prison term can order restitution (payment of financial losses). Your request for restitution must be in writing; it must list the items for which you are requesting restitution, the dollar amount requested, and the reasons for your request. The Rice County Attorney's Office will assist you in preparing your restitution request. Your request must be signed and submitted to the "Clerk of Court" at the courthouse where the sentencing will be held. If you need additional information about your restitution request, please contact our Victim Witness Program. You or others may be eligible for compensation for some of your economic loss from the Minnesota Crime Victims Reparations Board. Economic loss may include medical-related expenses, psychological-related expenses, loss of income, childcare services, loss of support, and burial expenses. This board can only pay restitution for person crimes such as murder, assault and robbery. They cannot pay for property crimes such as criminal damage to property, theft, or forgery. I am a victim in a domestic violence case. Can I drop the charges?

The decision to drop charges in any criminal prosecution is made by the prosecutor. The victim has the right to let the prosecutor know at any time their feelings. However, the victim's wishes alone do not dictate whether or not a case will be filed or dismissed.

What do I do before trial?

As a victim or witness, your cooperation with the prosecutor and law enforcement is essential. You may be contacted for further information. You will be informed by the County Attorney's Office of any special things you should do pending trial. If you change your address or phone number, please contact the County Attorney's Office as soon as possible.

In rare instances, the defendant or others attempt to influence the victim or witness through threats or coercion. Tampering with a witness is a crime punishable as a felony offense. Any concerns, threats or property damage you have should be reported immediately to your local law enforcement agency and our office.

What happens at trial?

The trial may be before a jury of twelve people or a judge alone if the defendant so requests. The trial begins with both sides having an opportunity to make an opening statement on the facts they expect to prove. The prosecutor then presents the State's case by using witnesses and exhibits. When the prosecutor has finished, the defense attorney may given an opening statement if it has not already been given. The defense attorney then may present a case using witnesses and exhibits. The defendant is not required to prove anything. The defendant is present in the courtroom during the entire trial. The defendant can decide not to testify. Once the defense has completed its case, both sides are allowed to make closing arguments, with the prosecutor going first. The judge or jury will then review the evidence they have heard and make a decision of guilty or not guilty. The prosecutor beyond a reasonable doubt must prove the defendant guilty. All jurors have to agree on the verdict.

What happens next in a criminal case?

When a Complaint (criminal charging document) is issued by the County Attorney's Office and signed by a judge, the defendant is scheduled for a first appearance in Court. A judge will then insure that an attorney represents the defendant. The judge also decides whether the defendant should be required to post bail or be released without bail. If the defendant doesn't post bail the defendant remains in jail. If requested, an Omnibus (pretrial) Hearing is scheduled. At the Omnibus Hearing, a judge decides what evidence may be used and whether there is enough evidence for the case to go to trial. Testimony from victims and witnesses is usually not necessary at the Omnibus Hearing. After the judge decides the Omnibus Hearing issues, the trial is scheduled. The trial usually is scheduled within six to eight weeks unless the defendant asks for or agrees to a trial at a later date.

The law requires counties to offer some offenders the option to participate in a diversion program rather than continuing through the court system. Certain first time property offenders may be eligible for the Rice County Adult Criminal Diversion Program. The goals of diversion include creating an incentive for offenders to change their behavior, ensuring full and prompt payment of restitution to crime victims, holding offenders accountable to society, and reducing costs associated with the criminal justice system.

Why are some defendants not in jail after they have been arrested and charged?

Under the laws of the United States and Minnesota, a defendant is presumed innocent until proven guilty. A defendant's release on his promise to appear at future court appearances is common. If the court determines that the defendant is unlikely to appear at future court dates or is a threat to public safety, bail or special conditions of release, such as no contact with victims or witnesses, may be imposed. Bail is a deposit of money held by the Court which can be forfeited if the defendant fails to appear in Court, breaks the law, or violates the conditions of release. You should notify the prosecutor of any concerns you have regarding a defendant's release or known violations of a defendant's release conditions.

Will I have to testify?

Testimony of victims is usually not required until the trial. Whether you will have to testify will be determined at the time of trial. The case may be settled through plea negotiations. This usually means no testimony from victims or witnesses is necessary. If your testimony is needed, you will receive a subpoena or notice to appear telling you where and when to appear. A victim has a right to give a statement at sentencing. Additional information will be sent to help you prepare for your court appearance.

Will this case go to trial?

Only a small percent of criminal cases go to trial, but many are set for trial. In most cases, the defendant pleads guilty. A plea negotiation is an agreement between the prosecutor and defense attorney to settle a criminal case by a plea of guilty or other appropriate disposition without a trial. A plea agreement is a way of settling a criminal case whenever it appears that the interest of the public, the victim, and the effective administration of criminal justice will be served without a trial.

How do I know if someone is on probation?

For adults, most of the probation information is public, and you can find out simply by calling Community Corrections or sending us an e-mail. We can tell you who's on probation, why they are on probation, the conditions of probation (and in general how they are complying with those conditions), when the probation period expires, and who the probation officer is. For juveniles over 16 on probation for a felony, the same information is public.

Can jury duty be rescheduled?

Yes. However, you will need to state the reason, in writing, why you cannot serve on a jury term. If approved, you will be rescheduled to a future two-week term.

Jurors must:

2) Be at least 18 years of age
3) Reside in Rice County
4) Be able to communicate in English

You cannot serve on a jury if you have been convicted of a felony and your civil rights have not been restored.

How long does jury duty last?

Jury duty in Rice County is two weeks. However, if you are seated on a jury, your service will be continued until the trial is completed. Jurors are required to serve for the duration of a trial.

Yes, your employment is protected under Minnesota Statutes 593.50, Subdivision 1. How do I add an additional member to my household voucher?

Section 8 participants must obtain prior approval from the HRA and Owner/Landlord before adding an additional adult member to the household. If an additional member is approved, the rent portion will be recalculated incorporating all household income.

Participants must notify the HRA Office in writing within 10 days of the birth, adoption, or court awarded custody of a child.

Section 8 participants have the right to select any eligible unit available to lease. Participants are free to rent from any Owner/Landlord who is willing to work with the Section 8 program. There is not a pre-approved Owner/Landlord list. How do I reserve a shelter at a County park?

Albers Park on Union Lake has a large pavilion that can be reserved for an event. The permit fee is $20. Please call (507) 332-6105 to arrange for a permit. Other park shelters are available on a first-come, first-serve basis. Special requests for reservations will be considered on case-by-case basis, with special consideration given to youth groups, educational organizations and non-profit organizations.

Is camping available at County parks?

At this time camping is permitted only at Cannon River Wilderness Area Park. The (four) campsites there are primitive hike-in or canoe campsites. A portable toilet is available from May - October at the east side parking area. Please pack out what you pack in.

A special event food stand is a food and beverage service establishment which is used in conjunction with celebrations and special events, and which operates no more than three times annually for no more than ten total days. All stands must be operated in compliance with the Minnesota Food Code.

Are well certificates required on all deeds?

In a transferring document, where the consideration is more than $500, a Well Disclosure Statement is required. The transfer document must contain a statement such as : "The seller certifies that the seller does not know of any wells on the described real property." OR "A well disclosure certificate accompanies this document." OR "I am familiar with the property described in this instrument and I certify that the status and number of wells on the described real property have not changed since the last previously filed Well Disclosure Certificate."

How do I obtain a permit to carry a firearm in public?

Applications for permits to carry a handgun must be submitted to the Sheriff of the county where the applicant resides and can be attained at the Sheriff's Office or online at: http://www.dps.state.mn.us/bca/Forms/Documents/CarryApplication100106.pdf

Do not sign or date the application form. That must be done in front of the records clerk accepting the application. All applications must be made in person. You will need a photo ID (drivers license or passport). All applicants must be at least 21 years of age and must not be prohibited from possessing a firearm by any state or federal regulation. You will be required to take an approved training course that includes both the legal aspects of carrying a firearm as well as a "hands-on" qualification portion. All applicants must provide a certificate showing completion of a qualified firearms training course prior to application. Training must be completed within 1 year of the application date. Permits are good for 5 years and there is a $100.00 application fee.

Renewal fee is $75.00. The permit can be renewed within 90 days of the date of expiration. If it's expired, a $10.00 late fee is required as long as you are within 30 days of the date of expiration. Once you've reached the 30 days, the application is no longer renewable. It will then be considered new, and the fee will be $100.00.

How do I obtain a permit to purchase a firearm?

The law regarding obtaining a permit to purchase a handgun has not changed. To obtain a permit to purchase a handgun you must apply at the Sheriff's Office Monday through Friday between 8:00 am and 4:30 pm. You must be 21 years of age, a resident of Rice County and have a Minnesota drivers license confirming your Rice County address. The permit will be processed within seven to ten working days from the time you make application. The criminal history of each applicant is checked. A record of conviction for certain crimes will be cause for denial of a permit.

How is contract policing different than having your own police department?

With contracting you do not have a local police chief although deputies often work long-term within the respective contract communities. The Sheriff's Office provides the administrative and supervisory capacity that normally is the responsibility of the police chief. We feel this can offer an advantage by allowing for a uniformity of policies, procedures, training and equipping of personnel. This reduces overhead and makes contracting more cost effective. The resources of a larger department also offer more flexibility with personnel issues. Contract cities are encouraged to form local police commissions to work with the Sheriff's office on local law enforcement issues.

The most common crimes in Rice County are property crimes such as, burglary, theft, criminal damage to property, and issuance of worthless checks, which make up the majority of all reported crimes in the County. What can I do with a worthless check?

Rice County does prosecute worthless checks passed in Rice County if they meet certain criteria. The Sheriff's Office however is not a collection agency. The check writer when prosecuted may be found guilty of a misdemeanor, which could result in a fine, and/or restitution for the check as ordered by the court. To obtain the forms and instructions, you may contact the Sheriff's Office Monday through Friday between 8:00 am and 4:30 pm either in person or by calling 507-332-6023. Post-dated checks, second/third party checks etc., checks accepted to hold, checks given as payment on an account, stop payment checks, checks in which partial payment has been received, and rent checks are not considered criminal and therefore cannot be prosecuted.

What if I have a hunter, snowmobile or ATV trespassing on my property?

Trespass is the most frequent complaint landowners have against the recreational public. Always ask permission before entering private land. Those who are trespassing are guilty of a misdemeanor, which is punishable by fines up to $1000 and a jail sentence of 90 days. If a landowner has a problem with people trespassing on their land, all they need to do is to call our office and a deputy or game warden will respond to investigate the complaint.

What is 'Pay for Stay"?

There is legislation which allows counties to charge a daily fee to convicted inmates. This daily fee, or per diem, is intended to offset some of the costs of incarceration. In December 2002, Rice County began charging $20 a day for inmate stays. In addition to the per diem rate, Rice County also bills the inmate for a booking fee of $10 and for reimbursement of any medical costs incurred while in custody. Unpaid invoices are submitted to a billing company for processing. Uncollected accounts are referred from there to a collection agency.

What is STS?

This is a program which places inmates in a work crew supervised by an employee of the Minnesota Department of Corrections. The crew performs work on public or non-profit projects, primarily within Rice County. The projects include such mundane tasks as roadside weed and brush control, to the more skilled and rewarding jobs like the construction of a log cabin in a state park. Participants in this program receive time off their sentences, or perform this service in lieu of payment of a fine and 'Pay for Stay"

What is the 'Huber Law"?

"Huber Law" or work release allows a person sentenced to jail to work at their regular place of employment during their normal working hours but they must return to the jail during their non-working hours. This opportunity is available at the discretion of the court and the inmate must pay the County $20 per day for this privilege for those sentenced in Rice County. There is an up charge for those sentenced outside Rice County.

    YARD WASTE:
    Minnesota law forbids the landfilling of yard waste such as leaves, grass clippings and brush. Minnesotans are encouraged to compost yard waste at home or bring yard waste to a community compost site.

    Composting is a process that uses water, air and naturally occurring microbes to convert organic matter into a valuable resource. Added to gardens or placed at the base of trees and shrubs, compost contains essential nutrients for healthy plant growth, acts as a soil conditioner, helps the soil to hold moisture better and prevents erosion.

    A backyard compost pile can be easily constructed and maintained.

The VIC Card protects the privacy of Veterans' sensitive information, as it no longer displays the Social Security Number or Date of Birth on the front of the card. The VIC Card will only display the Veteran's name, picture, and special eligibility indicators – Service Connected, Purple Heart and Former POW, if applicable, on the front of the card. Only Veterans who are eligible for VA medical benefits will receive the card.
